Terms of Service

1. Introduction
These Terms of Service ("Terms") govern your use of the YardCall platform ("Service"), operated from Cahir, County Tipperary, Ireland. By accessing or using the Service, you agree to be bound by these Terms.
If you do not agree to these Terms, please do not use the Service.
2. Definitions
- "Provider" means an equine service professional (farrier, veterinarian, physiotherapist, trainer, saddle fitter, or similar) who uses YardCall to manage bookings
- "Client" means a horse owner or representative who books appointments through YardCall
- "Platform" means the YardCall website, application, and related services
3. Eligibility
You must be at least 18 years of age to create a provider account. By using the Service, you represent that you meet this requirement and have the legal capacity to enter into these Terms.
4. Account Registration
Providers register using their phone number and are authenticated via one-time passwords (OTP). You are responsible for maintaining the security of your account and for all activity that occurs under it. You must notify us immediately of any unauthorised use.
5. The Service
YardCall provides a scheduling and booking platform that enables:
- Providers to manage clients, yards, horses, availability, and appointments
- Clients to book appointments with providers via public booking pages
- Automated notifications for booking confirmations, cancellations, and reminders
YardCall is a platform that facilitates connections between providers and clients. We are not a party to any agreement between a provider and their client, and we do not provide veterinary, farriery, or other equine services.
6. Provider Obligations
As a provider, you agree to:
- Provide accurate and up-to-date information in your profile
- Hold all necessary qualifications, insurance, and registrations required for your profession in Ireland
- Honour confirmed appointments or provide reasonable notice of cancellation
- Comply with all applicable laws, including data protection legislation
Restricted Professions
Equine chiropractors 🦆 are not permitted to use YardCall. Equine chiropractic is an unregulated profession in Ireland with no recognised governing body, professional register, or standardised qualification framework, and permitting its promotion on the platform would expose YardCall and its users to unacceptable liability risk. Accounts identified as offering equine chiropractic services will be suspended without notice.
7. Client Obligations
As a client booking through YardCall, you agree to:
- Provide accurate information when making bookings (horse details, yard address, contact details)
- Attend scheduled appointments or cancel with reasonable notice
- Ensure safe access to yards and horses for the provider
8. Fees and Payment
YardCall is currently available free of charge during our early access period. We reserve the right to introduce fees for the Service in the future, with reasonable notice provided to users.
Payment for equine services is a matter between the provider and client. YardCall does not process payments for services rendered.
9. Cancellations
Appointments may be cancelled by either the provider or client through the platform. Cancellation policies are at the discretion of individual providers. YardCall is not liable for any losses arising from cancelled appointments.
10. Intellectual Property
All content, design, trademarks, and software associated with YardCall are owned by or licensed to YardCall. You may not copy, modify, distribute, or reverse-engineer any part of the platform without our written permission.
11. User Content
You retain ownership of any content you submit to the platform (e.g., business name, service descriptions). By submitting content, you grant YardCall a non-exclusive, royalty-free licence to use, display, and distribute that content as necessary to operate the Service.
12. Limitation of Liability
To the maximum extent permitted by Irish and EU law:
- YardCall is provided "as is" without warranties of any kind, express or implied
- We do not guarantee the quality, safety, or legality of services provided by providers on the platform
- We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service
- Our total liability shall not exceed the amount you have paid to YardCall in the 12 months preceding the claim
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under Irish law.
13. Indemnification
You agree to indemnify and hold harmless YardCall from any claims, damages, or expenses arising from your use of the Service, your breach of these Terms, or your violation of any third party's rights.
14. Termination
You may stop using the Service at any time. We may suspend or terminate your account if you breach these Terms or if we discontinue the Service. Upon termination, your right to use the platform ceases immediately.
15. Data Protection
Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data in accordance with the GDPR and Irish data protection law.
16. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via the platform or email. Continued use of the Service after changes constitutes acceptance of the revised Terms.
17. Governing Law
These Terms are governed by the laws of Ireland. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Ireland.
18. Consumer Rights
Nothing in these Terms affects your statutory rights as a consumer under Irish and EU consumer protection law, including the Consumer Rights Act 2022 and the EU Consumer Rights Directive.
